Acceptance of Terms

By accessing or using erassales.com (the "Site") or placing an order with ERAS Sales LLC ("ERAS Sales," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Site.

Eligibility

You must be at least 18 years old and authorized to make purchases on behalf of yourself or your business to use the Site. By placing an order, you represent that the information you provide is accurate and that you have authority to enter the transaction.

Products & Pricing

We make commercially reasonable efforts to display accurate product information, pricing, and availability. Despite our efforts, errors may occur. ERAS Sales reserves the right to correct errors, refuse or cancel orders, and limit order quantities (including after an order is submitted) where pricing or availability errors are discovered.

All prices are in US dollars and exclusive of taxes, shipping, and any applicable duties unless otherwise stated.

Orders & Acceptance

Submitting an order constitutes an offer to purchase. ERAS Sales accepts the order when we ship the product or send an order confirmation specifically stating acceptance. We reserve the right to decline orders for any lawful reason.

Payment

Payment is due at the time of order unless you have an active B2B account with approved net terms. Approved net-terms accounts are subject to credit review and signed credit application. Late payments are subject to interest at the lesser of 1.5% per month or the maximum rate permitted by Maryland law.

Shipping & Returns

Shipping is governed by our Shipping Policy. Returns are governed by our Return Policy. Both are incorporated into these Terms by reference.

Warranties

Products sold by ERAS Sales are subject to the manufacturer's warranty, where applicable. Except for those manufacturer warranties and any warranty expressly provided by ERAS Sales in writing, products are sold AS IS and ERAS Sales disclaims all other warranties, express or implied, including warranties of merchantability and fitness for a particular purpose, to the maximum extent permitted by law.

Limitation of Liability

To the maximum extent permitted by law, ERAS Sales' total liability for any claim arising out of or relating to a purchase shall not exceed the amount paid by the buyer for the specific product giving rise to the claim. ERAS Sales shall not be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or business interruption.

Intellectual Property

All content on the Site — including text, graphics, logos, product descriptions, and the ERAS Sales name and trademarks — is owned by ERAS Sales or its licensors and is protected by US and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

Indemnification

You agree to indemnify and hold harmless ERAS Sales, its members, employees, and affiliates from any claims, losses, or expenses arising out of your breach of these Terms, your misuse of the Site, or your violation of applicable law.

Governing Law & Disputes

These Terms are governed by the laws of the State of Maryland, without regard to conflicts-of-law principles. Any dispute arising from these Terms or a transaction with ERAS Sales shall be brought exclusively in the state or federal courts located in Montgomery County, Maryland, and you consent to the personal jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time. The current version will always be posted on this page with the effective date. Continued use of the Site after changes constitutes acceptance.
